ALEXANDRIA, Va. (Aug. 17, 2023) – A group of pharmacy organizations backing Oklahoma’s right to curb the abusive behaviors of pharmacy benefit managers blasted a decision of the Tenth Circuit Court of Appeals allowing PBMs to escape certain state regulation by hiding behind the alleged preemption of that law by federal ERISA and Medicare Part D laws. 

APhA is saddened by the incalculable losses in Lahaina, Hawaii as the result of wildfires. While it remains too early to evaluate the full extent of the loss, pharmacy has been directly impacted.

“Specifically, we request FDA use its authority under the law for dispensers to comply with the EDDS requirements no earlier than February 27, 2026.”
