More U.S. states are considering or passing legislation that requires child-resistant packaging for e-liquid containers, but these laws vary in terms of their standards and definitions. Researchers from the Francis King Carey School of Law, University of Maryland, compared the proposed legislation against four benchmarks: product definitions that leave room for future market developments, references to a specific standard, penalties for violations, and express grants of authority to an agency to enforce the requirements. The researchers found that three state proposals meet all four of these benchmarks and suggest that other states may want to consider the benchmarks for future legislation.
